Matrimonial Home

 

The law protects the matrimonial home such that despite ownership by only one spouse, the other has rights to possession of this property after separation until there is an order of the Court.  This area of law is designed to protect a more vulnerable spouse from being evicted by the property owning spouse.  With the proper facts, a court can order exclusive possession order in favour of one spouse over another as well as delaying the sale of a home where appropriate.
